These terms are an agreement between you and Curb Coyote ("we," "us"), a trash and recycling bin take-out and return service in Farmington, New Mexico. By creating an account, buying a service, or using this website, you agree to these terms.
1. The service
We roll your trash bins, and recycling bins if you choose, from where you keep them to the curb the evening before your scheduled pickup day.
- Out and back: after the truck empties them, we bring your bins back to where you keep them, usually the same day and no later than the day after.
- Out only: we take your bins to the curb and you bring them back.
We are not a trash hauler. The City of Farmington or its contracted hauler collects your trash and recycling, and we do not control their schedule, what they accept, or how they handle your bins.
We serve addresses inside our service area, which we may change. We review every new address before the first service and may decline one we cannot serve safely or reliably.
2. Scheduling, holidays and weather
- Services follow the trash day and recycling week on your account. Tell us right away if your pickup day changes. A day change takes effect once we confirm it.
- When a holiday moves the city's pickup, we move your service to match. If we are not sure how a holiday affects your street, we roll your bins out on the normal evening.
- If the truck has not emptied your bins when we come back, we return later and bring them in once they are emptied.
- We may delay or skip a service when weather, road conditions or safety make it unreasonable to work. If we skip a service for our own reasons, your prepaid service is not used.
- You can skip a week in your account before the skip deadline shown there. After the deadline, the service counts as scheduled.
3. Your responsibilities
- Give us accurate account, address and contact details and keep them current.
- Keep your bins where your account says they are, with a clear, safe path to the curb.
- Give us any gate code or access instructions we need. We store gate codes encrypted and only crew on your route can see them.
- Keep dogs and other animals secured when we arrive.
- Follow the City's rules for what goes in each bin. Do not put hazardous waste, hot ashes, liquids, sharp objects without protection, or anything the City does not accept in your bins, and do not overfill them. Lids must close.
- Keep bins reasonably light enough to roll by hand. We may leave a bin that is overloaded, damaged, or unsafe to move.
- You must be at least 18 years old and have the right to authorize service at the address.
If we cannot reach or safely move your bins because of something within your control, such as a locked gate, a blocked path, or a loose animal, the visit counts as a completed service.
4. Photos
When we place or return your bins, we may take a photo of them at the curb or back in place as proof of service. The photo may show part of your property. We keep these photos for 60 days and then delete them. See our Privacy policy.
5. Prices and payment
All services are paid in advance by card or PayPal through our payment processors. We never see or store your full card number.
- Single service: one service, paid when you buy it.
- 5-pack: five services at a lower per-service price. Unused services expire 365 days after purchase. We remind you 30 days before they expire.
- Weekly plan: service every pickup week at our lowest per-service price, billed monthly in advance. Each billing period runs from the day your plan starts to the same day the next month. Your first payment covers the pickups in your first period. After that, about two days before the first pickup of each new period, we charge your saved payment method for the pickups in that period. Some periods have four pickup days and some have five, so the amount can change from month to month. If a skipped week or a late start leaves you with a paid pickup, it carries forward and you are charged only for the pickups you still need. The plan renews automatically until you cancel.
Extra bins beyond two add the extra-bin fee shown on our pricing page. Prices include or add New Mexico gross receipts tax as shown at checkout.
We may change prices. For weekly plans we tell you at least 14 days before a new price applies to your plan. Prices for services you already paid for do not change.
If a renewal payment fails, we try again and let you know. If it keeps failing, your plan is paused until payment is made.
6. Pausing and canceling
You can pause or cancel a weekly plan at any time in your account. When you cancel, renewals stop right away. Services you already paid for still happen unless you skip them or ask for a refund under our Refunds policy.
We may suspend or end service if payments are not made, if you break these terms, if your address leaves our service area, or if it becomes unsafe for our crew to serve you. If we end service for reasons that are not your fault, we refund services you paid for and did not receive.
7. Limitation of liability
We take reasonable care with your bins and property. We are responsible for damage we cause through our own carelessness. Please report any problem within 48 hours so we can look into it while the details are fresh.
We are not responsible for:
- what the hauler does or does not do, including missed pickups, spills, or damage to bins during collection;
- bins moved, tipped, or damaged by wind, animals, vehicles, or other people after we place them;
- the contents of your bins, or fines or fees caused by what you put in them;
- normal wear on bins and wheels;
- delays or skipped services caused by weather, road closures, holidays, or other events outside our control.
To the fullest extent the law allows, our total liability for any claim related to the service is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be limited under New Mexico law.
8. Text messages and email
If you opt in, we send service texts as described in our Text messaging terms. You can change your notice settings at any time in your account.
9. Changes to these terms
We may update these terms. We post the new version here with a new "last updated" date, and we tell account holders about material changes by text or email. Continuing to use the service after a change means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the State of New Mexico. Any dispute will be handled in the courts of San Juan County, New Mexico, unless we both agree otherwise.
